New Legislation Calls for More Registered Nurses in Nursing Homes

Illinois Representative Jan Schakowsky-D introduced House Bill 5373, or the Put A Registered Nurse in the Nursing Home Act, on July 31st after learning that more than 1,500 (about 11%) nationwide nursing homes do not employ at least one 24-hour registered nurse. Ms. Schakowsky’€™s legislation would require all nationwide nursing homes that receive Medicaid or Medicare to employ a direct-care registered nurse 24-hours per day, seven days per week.

The astonishingly low number of registered nurses employed by nursing homes offers some insight into the poor care some seniors receive at elder care facilities. Though many nursing homes employ licensed practical nurses and certified nursing assistants to care for their patients, registered nurses account for the highest classification of certified caregivers. Registered nurses are additionally the only classification licensed to evaluate and assess a patient’€™s condition.

According to nursing home studies, many patients experience fewer instances of abuse and neglect when a 24-hour registered nurse is available, including decreased urinary tract infections, fewer hospitalizations, and fewer bedsores.

So why are registered nurses so scarce in an environment that requires the highest quality of care? Facility & Staff Face Charges in Nursing Home Abuse Investigation

ABC News reported that arrest warrants were issued for 21 employees of the Alzheimer’s Care of Commerce in Northeast Georgia. These employees now face more than 70 charges, including cruelty to people 65 or older, abuse, and neglect, among others. In several instances, acts of physical abuse were documented, and revealed that staff members struck patients residing at the Alzheimer’s Care of Commerce.

The Georgia Bureau of Investigation continued their three-month probe for additional evidence of nursing home abuse by obtaining a search warrant. While searching, authorities found that bed sheets had been used to restrain patients, patients had been struck or hit with water, and several employees had prior felony convictions ranging from manslaughter to drugs. Among the suspects is the center’s owner as well as former and current employees.

According to the results of a Special Investigations Division of the House Government Reform Committee study, more than 30% of nursing homes in the United States alone received citations for nearly 9,000 accounts of abuse over a two year period. Nursing home neglect and abuse issues reported include:

Former Miss Teen Oklahoma Wrongful Death Suit Settled

Almost a year after the boat crash that killed former Miss Teen Oklahoma Rachel Nicole Swetnam and William Lewis €œTrey’€ Varner III, the Swetnam and Varner families have found justice. The wrongful death suit filed by the Swetnam and Varner families was settled for an unspecified amount, and the boat driver continues to face charges for first-degree manslaughter.

At the time of the accident on May 14, 2013, Swetnam and Varner were seated on the bow of a boat driven by John DeSelms. With a blood alcohol level of .18, more than twice the legal limit of .08, DeSelms drove the boat into an unoccupied and docked house boat. Swetnam and Varner were later found dead on the scene.

After the accident, the Swetnam and Varner families filed wrongful death suits against DeSelms, the DeSelms family, and the boat’€™s owner, Seven Anchors LLC. Family Awarded $3 Million after Newborn’s Death

A Bryant County jury awarded $3 million for the death of a baby in a car crash. At the time of the crash, Murphy Foster McKeel, the baby, was in utero. As a result, he was prematurely delivered, sustained brain damage, and died a month and a half later.

After just three hours, the jury awarded $2 million for the life of the baby, $1 million for the mother’€™s pain and suffering, and $83,000 for the father’€™s loss of consortium.

Erica McKeel, the baby’€™s mother, was seven months pregnant with her first child when the crash occurred on January 5, 2012. She was driving on GA 144 in Richmond Hill, heading to work at the Bryan County Recreation Department when another driver turned left in front of her. Although she sounded her horn and tried to miss the oncoming car, she was unable to avoid the collision.

Defendant Cuong Nguygen was driving a car owned by his brother, Minh Nguyen. Both drivers were taken to the hospital by ambulance.

On January 6, while in the hospital, McKeel’€™s amniotic sac broke. She was given antibiotics and remained in the hospital for two weeks. Yet infection developed, and the placenta abruption (a condition in which the placenta looses from the uterine wall) caused bleeding. The baby had to be delivered via emergency c-section.

Although the defense succeeded in an effort to drop the owner of the car from the case, they failed to remove Limelight Bar & Grill, the business in which the driver and brother were part owners, from the case. Limelight Bar & Grill was covered by a $2 million auto insurance policy.
