Atlanta Area Toddler Critically Burned in SWAT Raid

While serving a no-knock arrest warrant at 2 am, on Wednesday, May 28th, 2014, an Atlanta area toddler was critically burned by a SWAT team stun grenade. The 19-month-old boy remains in critical condition in the burn unit at Grady Memorial Hospital.

During their initial entrance, deputies threw a stun grenade, which landed in the toddlers crib and exploded on the pillow. Acting on information from a confidential informant, the multijurisdictional SWAT team was unaware that children lived in the house.

The local police chief said, €œYou’re trying to minimize anything that could go wrong and in this case the greatest thing went wrong. Is it going to make us be more careful in the next one? Yes ma’am, it is. It’s going to make us double question.’€

There is an ongoing district attorney investigation into the SWAT team raid to determine if any criminal charges will be filed.

The 19-month-old boy is currently in a medically induced coma while doctors treat his burns and lacerations. Doctors believe the young boy is paralyzed and lost the use of one lung. Severe burn injuries caused by explosions, like stun grenades, can require months of recovery and multiple reconstructive surgeries or skin grafts.

After catastrophic accidents and burn injuries, families are able to file suit against negligent parties. The results from the ongoing DA investigation will help determine the level of police negligence and fault. Our team at Moraitakis & Kushel LLP strongly recommends that families seek legal representation after a burn injury caused by negligence.

Another Tragic Trucking Accident Increases Public Concern

On the night of September 26th, a trucking accident near Davis, Oklahoma resulted in the deaths of four softball players from North Central Texas College. The results of a toxicology test have not yet been revealed, but police report that the truck driver, Russell Staley, was found dazed in his cab with a bag containing several prescription drugs, some of which were known to cause drowsiness, and a silver pipe that allegedly smelled of marijuana.

Accident Increases Public Outcry for Trucking Industry Reform

Tragic stories like this have become all too familiar and all too frequent. Especially since the June 7thNew Jersey Turnpike accident that critically injured comedian Tracy Morgan and killed comedian James McNair, the subject of truck driver fatigue has gained increasing media attention. After Tracy Morgan’€™s accident and fatal accidents like this in Oklahoma, the public has called for stricter reforms and regulation in the trucking industry in order to prevent future accidents.

It is not yet known whether or not Staley, the truck driver responsible for the Oklahoma accident, was sleep-deprived at the time of the accident, but the evidence of prescription and potentially illegal drugs in his truck cab is very disturbing.

A spokesman for the National Transportation Safety Board has said that the organization will be implementing a full investigation into what caused the accident, in the hopes of determining what could prevent future, similar accidents.

While it is likely completely eradicate all automobile and trucking accidents, the expert attorneys at Moraitakis & Kushel believe that those accidents that are avoidable should be prevented by the trucking company regulations and safe, responsible driving habits by truck drivers. While the loss of four young women is tragic in itself, the tragedy is compounded by the fact that the accident could have most likely been prevented if proper safety guidelines had been followed.

$3M Verdict Increased to $4.5M in Case for Boy Suffering Brain Damage

A Fulton County judge recently awarded a $4.5 million dollar verdict in a medical case to a brain-damaged five year old boy and his guardian ad litem, Nicholas C. Moraitakis. When the boy’€™s parents, Annette Clemons and Jason Cole, noticed that their newborn son Trevor seemed lethargic and less hungry than his twin sister, they took him to the hospital. Trevor was eventually diagnosed with maple syrup urine disease, a condition which prevents the body from processing certain amino acids, and can cause brain damage if left untreated.

Trevor’€™s parents filed a lawsuit in DeKalb County against several medical and healthcare professionals, and reached several settlements in 2012. The remaining defendants, Dr. Gregory Sysyn and Neonatology Associates of Atlanta, denied a settlement of $2 million after Trevor’€™s parents dropped all claims a few days before trial, leaving Trevor as the sole plaintiff. The case was moved to Fulton County.

The jury at Fulton County decided on a total verdict of $7.5 million, in which Dr. Sysyn and Neonatology Associates of Atlanta would be responsible for 40 percent. Trevor and guardian ad litem, Nicholas C. Moraitakis, were represented by James Poe and Charles Hehmeyer, who filed motions for two amendments to the court’€™s final judgment. Poe amended to add interest accrued from 2012, when the first offer of judgment was made, to the $3 million award under the Georgia’€™s Unliquidated Damages Act. The next motion for amendment was to add the 40 percent contingency fee and expenses under Georgia’€™s offer of judgment statute.

The defendants’€™ representatives, John Hall and Russell Davis, argued that there was a €œsubstantial change in the complexion of the case’€ when Trevor’€™s parents dropped all claims. Secondly, Davis and Hall argued to void the contingency fee and expenses due to the lack of evidence of the amount and cost of the work by the plaintiff’€™s lawyers. Lastly, the defense claimed that the plaintiff had exterior motives, by seeking extra damages under both the offer of judgment and unliquidated damages statutes.

All arguments were dismissed by the judge, and the plaintiff was awarded a $3 million verdict, $107,534 in pre-judgment interest, $1,243,013 in attorney fees, and $128,497 in expenses; totaling to $4.5 million.

$200 Million Paid by VA in Wrongful Death Cases

While many veterans receive high quality healthcare after their military service, in the past decade, the Department of Veterans Affairs has provided more than $200 million dollars in compensation for wrongful death suits. Journalists at the Center for Investigative Reporting recently found data from the VA about wrongful death payments made to nearly 1,000 military families.

Unfortunately, across the United States, veterans of all ages received inadequate care from the VA. The veteran wrongful death victims served in conflicts from World War II to the War in Iraq. The cases took place in 49 different states and Puerto Rico. The wrongful death suits ranged from nursing home negligence and untreated cancerous tumors to missed diagnoses and refused mental health services.

On average, the grieving families received $150,000 for the death of their loved one. Unlike medical service in the private sector, families of VA victims are excluded from punitive damages, and must go through an extensive administrative review. Using the exhaustive VA system, many suits carry on for years without compensation.

In the coming days, a congressional hearing is scheduled to discuss the growing number of wrongful death cases emerging from VA facilities. Top VA officials will be asked about employee discipline, unreported disease outbreaks, and extravagant bonuses given to high-level directors.

According to Representative Jeff Miller, chairman of the House Committee on Veterans Affairs, €œIt’€™s not enough for VA to simply compensate the families of those who died. In order to provide real closure for those struck by these heartbreaking preventable deaths, VA needs to hold fully accountable the employees who allowed patients to slip through the cracks.’€

Nick Moraitakis Speaks at 2013 GTLA Annual Conventions

ATLANTA, GA (June 3, 2013) €” Leading Atlanta trial attorney Nick Moraitakis, partner in the Moraitakis & Kushel, LLP, Law Firm in Atlanta, Georgia, recently spoke at the 2013 Annual Convention for the Georgia Trial Lawyers Association (GTLA).

Held May 16th-17th, 2013 at the Loews Atlanta Hotel, the 2013 GTLA convention included a number of speakers and special events designed to educate attendees on ethics, professionalism and other topics.

Mr. Moraitakis was tapped to speak on the following topic: off campus premises liability, more specifically the dram shop case. As a top dram shop lawyer in Atlanta, Mr. Moraitakis went into detail on the dram shop statute and case law in Georgia.

Georgia is a dram shop state, meaning that if a patron at a bar, nightclub or restaurant is visibly intoxicated and the bar tender continues to serve alcohol with the knowledge that the patron will be driving, the establishment has shared legal liability.

‘€œThe Georgia Trial Lawyers Association is a great organization that helps protect the right to a trial by jury, € Mr. Moraitakis said. €œI was thrilled to be able to share my insights on dram shop cases and the statute in general.

Mr. Moraitakis, co-founder of the Moraitakis & Kushel, LLP, Law Firm in Atlanta, has over 30 years of experience in the legal field. After graduating from Emory Law School in 1977, Mr. Moraitakis immediately began practicing law with a defense litigation firm in downtown Atlanta, which eventually became known as Fain, Gorby, Reeves & Moraitakis. In 1993, Nick joined Glenn Kushel to begin a plaintiff’€™s practice dedicated exclusively to the representation of individuals injured or killed as a result of medical malpractice, nursing home abuse, trucking accidents, automobile accidents, product liability, premises liability and other negligent and intentional acts. Mr. Moraitakis has litigated many cases in State, Superior and Federal Courts to successful conclusion, and has served as lead counsel for presentation of oral argument in many cases before the Georgia Court of Appeals and Georgia Supreme Court. His full bio is available online at http://mktriallaw.com/our-team/nicholas-moraitakis/.

The GTLA, founded in 1956, has a mission of €œprotecting the Constitutional promise of justice for all by guaranteeing the right to trial by jury, preserving an independent judiciary, and providing access to the courts for all Georgians, € according to the website, http://www.gtla.org/GA.
